They have an uphill legal fight, as Volokh makes clear. Moreover, I suspect that social justice warriors across the country will be reporting every frat boy from this fraternity who so much as spits on the sidewalk and arguing that this lawsuit will re-victimize rape victims. They should probably walk away at this point, as unjust as that is.
