There have been a number of cases recently involving attempts by universities to sell art collections or public radio stations. See, for example, Brandeis University and the Rose Art Museum; Fisk University and the Georgia O’Keefe art collection; Boston University University and WBUR; St Olaf College and WCAL (the first listener supported radio station in the nation).
All of these cases involve multi-million dollar contributions by donors. Now the courts will decide whether these contributions for charitable purposes created charitable trusts in which the universities have a fiduciary duty to honor the intent of the donors.
The Minnesota Court of Appeals has now set the date for the oral argument on the WCAL case for October 27, 2009 at the Minnesota Judicial Center in St. Paul.
