You can say that again.
This will likely be a pretty big story – an eminent literature professor is arrested for prostitution, with mug shots provided of him in drag and out of drag.

Entrapment. Why on earth is that still legal?

Farah: I agree that there are all sorts of legal issues here.

Read the article twice to be sure. If the article accurately represents what happened, nothing even close to entrapment occurred. He advertised publically, the police responded undercover (as they are, of course, allowed to do) and he agreed to sex for money. Again, all according to the article. Where is the entrapment?

Van: Is the difference here that he advertised?

It is only part of it. To show entrapment, you must show that the government agents basically overpowered your will and got you to do something that is completely out of character. That is why the defense is so seldom successful. A couple of recent terrorism trials in my area showed that the federal agents or CIs did about 90% of the work, but the federal prosecutions were allowed to go to a jury, which convicted. We will see about the appeal. If the defendant was advertising for sex, it would be difficult for him to argue what he agreed to was out of character or that he was brow-beaten into doing something he would not ordinarily do.

Thanks for that clarification, Van.
